Terms and Conditions
All orders placed by you via the Website www.clemens-en-august.com and our deliveries and services are exclusively subject to the following General Terms and Conditions, in the version that is valid at the time of the order.
Delivery
Delivery within the EU will be via DHL or UPS within 8 business days, after receipt of payment on our account or after the payment by saferpay.
Delivery to non-EU countries
varies depending on the delivery periods of DHL or UPS, the mode of shipment and the custom duty of the concerning country. Please note that we bear the costs for the shipment from our warehouse to your home, the insurance of the merchandise and any costs for supplementary documents. Product prices are exclusive of all taxes and duties, as well as German VAT. Please note that custom taxes, duties and handling fees for each individual country will be applied and invoiced separately through the forwarder or your country.
Forwarding Expenses
We charge 10€ for delivery within Germany, 15€ within the EU and 35€/55€ for the delivery outside EU, depending in the distance of the country and the delivery costs of our forwarder.
The exact forwarding expenses are shown during the ordering process.
Important notes
Please note that ordered articles might not be available at the time of ordering. If this is the case a Clemens en August representative will contact you in due course.
Although we try to represent our products as close to the real thing as possible, there may still be differences caused by screen, graphic or printer settings.
A hang tag will be attached to all the products we deliver. Please pay attention not to damage or remove this hang tag when you try on the clothes. As the return of the clothes is only possible with undamaged hang tags.

Right to return, Exchanges and Refund
You may return merchandise that you have received within two weeks by sending the merchandise back. The time limit starts running the day after the day on which you have received the merchandise. All goods must be returned in original condition along with a copy of your initial invoice. Please indicate the reason for your return on the back of your invoice form. In the event of return, delivery costs are at the customer`s charge.
Consequences of Return
In case of a valid return, the mutually received benefits are to be returned and eventually drawn profits (e.g. profits drawn from the use of the merchandise) are to be returned. In case that the merchandise has deteriorated, a compensation regarding the value may be claimed.
This does not apply in case that the deterioration of the merchandise exclusively results from its inspection as it would have been possible for you in a shop. You also can avoid the obligation to compensate the value by not using the merchandise as if you owned it and by refraining from acts that might affect its value.
Payment, Default
You may pay your order to Alexander Brenninkmeijer GmbH & Co Kg via wire transfer, credit card (Visa, Master, Amex)and within Germany ELV (Elektr. Lastschriftverfahren).
The purchase price and the forwarding expenses of the ordered products have to be paid in advance. The payment in advance has to be made immediately after ordering. In case the ordered product is not available, we will retransfer the amount promptly.
Procedure for payment via wire transfer
1. You will receive our bank details and the order number in the email
that confirms your order.

3. We process your order upon receipt of the payment.

Procedure for payment with credit card
1. You enter your credit card data on a secured payment website www.saferpay.com.
2. The encrypted data will be sent by the SSL system to the credit card institute. SSL (Secure Socket Layer). This is an asymmetric encryption method in the internet that secures your credit data during the transmission process against access and manipulation. Therefore, it is not possible for third parties to read these data during the transmission over the internet.
3. Upon the successful check of the credit card the invoiced amount will be charged automatically. This automatized process guarantees the correctness and the security of the transaction. You may receive more information under www.saferpay.com.
Note: Credit items resulting from returns will be transferred back to your credit card.
Retention of Title
Until full payment Alexander Brenninkmeijer GmbH & Co Kg retains its title to the merchandise.
Warranty
Statutory warranty provisions apply.
Confidentiality
1. We use your personal information only for the completion of transactions. All customer information is stored and processed according to the relevant guidelines of the german federal privacy protection law (Bundesdatenschutzgesetz, Bdsg) and the teleserviceprivacy law (Teledienstdatenschutzgesetz, Tddsg). You have the right to demand access, correction, closing or deletion of personal information at any time and without cost.
2. You may at any time request information about the data we have saved, and also have a right to correct, block and delete your data. You may address your request to us by email to info@clemens-en-august.com or telefax 0049 89 5439028.
3. We do not forward personal data to third parties. This does not apply with regard to subcontractors who require the data in order to process the order. In these cases, however, the scope of the data transfer is restricted to the required minimum.
Choice of Law, Validity
1. German law applies with the exception of the United Nations Convention on Contracts for the International Sale of Goods.
2. In case that one or more provisions are invalid, the validity of the remaining provisions remains unaffected.
